Unlike every other fraudulent auction I have flushed out, there is a possibility that this one may actually have some ties in the US. There would have to be someone in Florida to pick up the cashiers check and cash it. I am going to TRY and get Orlando police involved.

If it were his unit he'd find that a hard job... the first few batches where numberless, mine (the one pictured) is one of those.

As an aside- can't you get binned off ebay for over-bidding items to kill the sale? Its nice to safeguard others this way but isn't it some kind of contract when you bid? (I'm not an ebay expert, only got 10 rating and a little yellow star :-( Wouldn't like to see anyone having the credit card company contacted by ebay!

The Ebay security team loves my reports. I personally directed the shut down of 5 compromised accounts in the last hour like the one below. I always bid like a maniac on auctions that I KNOW are fraudulent. I do computer security for a living, so maybe I am a bit cocky. Nonetheless,the only thing I have gotten for my actions is extreme pleasure in making criminal's jobs tougher.

You guys are awesome.....

As far as contracts are concerned, in most Sates the Civil Codes set forth lawful grounds for extinction of contracts based upon fraud, or misrepresentation, or MISTAKE.

If you honestly believed with some articulatable, convincing evidence beyond a preponderance of evidence (the 51% rule) that the auction was a scam, then you would rely upon the defense of MISTAKE if the auction turned out to be legit and someone tried to sue you for breach of contract.

If I mistakenly bid high on a rebreather I thought was a scam and it turned out to be legit, I would offer my fellow rebreather diver/seller his relisting fees if the next highest bidder didn't want it, and I would think any real rebreather owner would accept that as full restitution and be greatful our community looks out so diligently for each other like everyone I know here.

Laudable though it is to be proactive about potential Ebay fraud, it might be better to let Ebay sort things out themself using their own mechanisms.

For one thing, the sale of this item attracts a fee from the seller. This is automatically debited from the seller's account by Ebay.

Having your Ebay account hijacked is bad enough (been there, done that), but being charged a successful seller fee for the privilege is even worse, especially if it for an auction that has been artificially inflated.

Sure there's probably a process to ensure a refund, but equally surely it's neither easy nor instant.

If E-bay were left to their own devices to sort things out, considering in any given moment I can find over a dozen big ticket scams within 5 minutes, when it comes to suggesting E-bay will root out fraud, one has to ask;

How is it going so far for E-bay?

Unlike E-bay who goes through the motions of trying to root out fraud that they profit from, maybe these guys who bid rediculously high are doing a HUGE service not for E-bay, but to protect fellow divers who want to buy a rebreather from getting ripped off?

You guys are awesome..... As far as contracts are concerned, in most Sates the Civil Codes set forth lawful grounds for extinction of contracts based upon fraud, or misrepresentation, or MISTAKE. If you honestly believed with some articulatable, convincing evidence beyond a preponderance of evidence (the 51% rule) that the auction was a scam, then you would rely upon the defense of MISTAKE if the auction turned out to be legit and someone tried to sue you for breach of contract. If I mistakenly bid high on a rebreather I thought was a scam and it turned out to be legit, I would offer my fellow rebreather diver/seller his relisting fees if the next highest bidder didn't want it, and I would think any real rebreather owner would accept that as full restitution and be greatful our community looks out so diligently for each other like everyone I know here. Keep up the good work guys....

Laudable though it is to be proactive about potential Ebay fraud, it might be better to let Ebay sort things out themself using their own mechanisms. For one thing, the sale of this item attracts a fee from the seller. This is automatically debited from the seller's account by Ebay. Having your Ebay account hijacked is bad enough (been there, done that), but being charged a successful seller fee for the privilege is even worse, especially if it for an auction that has been artificially inflated. If E-bay were left to their own devices to sort things out, considering in any given moment I can find over a dozen big ticket scams within 5 minutes, when it comes to suggesting E-bay will root out fraud, one has to ask; How is it going so far for E-bay? Unlike E-bay who goes through the motions of trying to root out fraud that they profit from, maybe these guys who bid rediculously high are doing a HUGE service not for E-bay, but to protect fellow divers who want to buy a rebreather from getting ripped off?
