| Re: Unused O2ptima for sale Nope, I did not sell it. I used a copyrighted image from the DiveRite catalog and Lamar hollered to get it down. It is now on the way to my workshop in Hawaii, as I had no choice but to buy it. Next time, I will put actual photos of it with a serial number. |

| Re: Unused O2ptima for sale That's not the point. Using a "copyrighted image" to sell the actual product in question is not a reason to holler. Oh yeah, you CAN force someone to take it down, but you shouldn't, because its not a "misuse" of the image to actually represent what it is! You'd think that any manufacturer would want their product represented honestly in the marketplace. Sheesh.

| Re: Unused O2ptima for sale Actually, the real issue is more likely that Dive Rite sees an Optima on Ebay at this point in time (just as they are being finally released) as very negative publicity. I'd guess the "copyrighted image" ploy was just a convenient lever to save the Optima's karma. Darlene |

This was just churlish behavior on DiveRite's part - once he physically has delivery he can take all the pictures he wants and sell it on eBAY, and there is nothing they can do about it. In short, all this was was a raw attempt by DiveRite to cost him money, since the listing fee is non-refundable, and force him to take delivery (although the order WAS NOT THEIRS - it was DREs.) In that light it is an utterly indefensible act; the image was NOT being used to deceive in any way.

I just think it was motivated by their perception that a new Optima on Ebay would be negative publicity, and somehow taint how people see it. | Re: Unused O2ptima for sale If it was a legitimate listing, of course the seller has every right to list and sell the item on eBay. However, the manufacturer sees a listing on eBay for a high value product in so limited supply that the CEO is personally aware of the name to whom every single unit has been sold... and believes the listing is not from one of the individuals who has taken delivery. There is more than one way to look at this...... First, consider that holders of copyright are required by law to protect their copyrights, or lose them. eBay has a whole program to provide for protection of copyrighted descriptions and photos and even extends that protection to other photos and descriptions on eBay posted by individuals. Infringement can cause the poster of such content a good bit of grief - including loss of privledges on Ebay. I thought Dive Rite was being very nice to only request the poster to show their own photo of the unit and the unit serial number, which does not seem to be an undue burden, rather than use the eBay program.... see this page http://pages.ebay.com/help/confidenc...s-vero-ov.html Second, and most importantly, the stories of 'ripoff' attempts by listing non-existant and stolen rebreathers on Ebay are well documented... Instead of outrage, you should feel pleased that a manufacturer would go to the trouble of making sure that the listing is genuine by checking the serial number and insisting on an actual photo of the unit offered.
