Welcome to Rebreather World.

There is no question that diving a rebreather will put you at an extreme advantage while spearfishing. This fact is not lost on some U.S. states with fisheries conservation initiatives. I can confirm that it is illegal to spearfish with a rebreather in Florida, and I recall reading the same about California.

Can anyone else confirm?

It is NOT illegal to spearfish with a rebreather in Hawaii. I still spearfish occasionally while free diving, but do not with a rebreather. I will admit the temptation is mighty strong when I see a prime 10-meal specimen swim inches from my mask while on a deco stop.

As far as sharks, yes, being underwater will make you less likely to be mistaken as the silhouette of Whitey's favorite meal, but if you are spearfishing, all bets are off. With blood in the water, you are provoking an attack. Of the very, very few fatal shark attacks on scuba divers (as opposed to the plethora of free divers), most of them have involved spearfishing.
